Cottage food products are specifically non-time/temperature control foods such as baked goods and jams. The legislation exempts these operations from most permitting, licensing, inspection, packaging, and labeling requirements typically applied to food establishments, while still maintaining public health safeguards. Cottage food operators must provide specific consumer information on their products, including the business name, address or personal ID number, product name, ingredients, and a disclaimer about the home-based production. The bill establishes a voluntary registry with the Department of Public Health, allowing operators to obtain a personal identification number for labeling purposes for a fee not exceeding $25. Importantly, local boards of health are prohibited from establishing additional rules for cottage food operations, and the bill maintains that the Department of Public Health and local health boards can still investigate potential foodborne illness concerns and provide assistance to producers if requested.
