For cases involving avoidable injury, the program encourages providers to offer a sincere apology and, when appropriate, provide fair and timely compensation without resorting to litigation. Additionally, the bill modifies reporting requirements for professional liability insurers, stipulating that settlements made as part of a CARe program will not automatically be reported to the medical board against a physician unless there is a determination of substandard care.
