This bill establishes a new board of hoisting machinery regulations within a state department, consisting of six members appointed by the governor for four-year terms. The board's composition includes specific representatives: a chief inspector (who serves as a non-voting chair), a public utility employee, a private construction contractor, a safety trainer authorized to conduct continuing education for hoisting licenses, an Occupational Safety and Health Administration (OSHA) expert, and a representative from the International Union of Operating Engineers with at least five years of experience in hoisting machinery operations. The board will have the authority to create rules and regulations for classifying hoisting machinery and establishing procedures for issuing, denying, renewing, suspending, and revoking licenses for apprentice operators. License criteria will include training, experience requirements, and registration with the apprenticeship council. Apprentice license holders may only operate hoisting machinery under the supervision of a fully licensed operator. The board can conduct business with a majority present and may, with approval and subject to funding, hire an executive secretary and additional staff to support their work. Importantly, any final determination of a violation of federal or state occupational safety regulations can result in license denial, revocation, or suspension.
