This bill adds a new section (Section 40F) to Chapter 82 of Massachusetts General Laws that establishes clear requirements for restoring public ways after excavation. Specifically, any person, corporation, or entity authorized to excavate a public road, sidewalk, or curb must, at their own expense, restore the surface to its original condition or better using the same or similar materials. The restoration must adhere to Department of Public Utilities regulations and include the reinstatement of all original surface markings such as crosswalks, lane lines, bike lanes, and symbols. Furthermore, the entity performing the excavation will be legally responsible for any damages to the restored surface for one year after completing the work. The bill will go into effect one year after its passage, giving entities time to prepare for and understand the new restoration requirements.
