This bill establishes the Dukes County Sheriff's Regional Lockup Fund, a dedicated state fund administered by the Dukes County Sheriff's Office to provide a regional lockup service for towns in Dukes County. The fund will serve as a centralized detention facility where individuals arrested with or without a warrant, taken into protective custody, held on contempt, or arrested under civil process can be detained. Police officers will have full jurisdiction while transporting detainees to the facility, including during transport through different jurisdictions and to medical facilities or transportation hubs. Municipal police departments that join the regional lockup system will be exempt from certain existing detention regulations, and towns can become members by executing a written agreement with the Dukes County Sheriff. The regional lockup facility superintendent and deputy sheriffs will have the same authority as police officers to detain, book, hold, and transport pre-arraignment and other incarcerated individuals. The fund will be supported by legal transfers, authorized deposits, gifts, grants, and contributions, and uniquely, the money will not be subject to further appropriation and will not revert to the General Fund at the end of each fiscal year, ensuring continuous funding for the regional lockup service.
