The bill introduces a definition for a "labor peace agreement" as a contract between a marijuana establishment and a labor organization that allows union agents to communicate with employees about their labor rights in exchange for prohibiting picketing, work stoppages, or boycotts. For marijuana establishment license applications and renewals, businesses must now submit an attestation confirming they will not interfere with employees' ability to form and maintain a union. The bill also requires the cannabis control commission to create and periodically update a list of "bona fide labor organizations" that meet specific criteria, such as having collective bargaining agreements, a written constitution, filed financial reports, or affiliations with national labor organizations. To qualify for inclusion on this list, labor organizations must be free from employer domination or interference. The cannabis control commission is tasked with developing regulations for implementing these provisions in consultation with the executive office of labor and workforce development, with an exemption for small businesses as defined in existing regulations.
