The legislation allows these professionals to restrain or authorize the restraint of an individual and apply for hospitalization if they determine, after examination, that the person poses a serious risk of harm to themselves or others due to mental health issues. In emergency situations where an examination is not possible or the person refuses consent, these professionals can still apply for hospitalization based on the circumstances. The bill also allows police officers to restrain and apply for hospitalization if no other qualified professional is available. Additionally, the bill requires that whenever possible, the applicant should communicate with the receiving facility in advance to discuss the individual's circumstances, clinical history, and potential need for restraint.
