This bill amends Section 11F of Chapter 25A to update regulations for Class 2 renewable energy generating sources. The bill expands the definition of Class 2 renewable energy sources to include various types of renewable energy generation, such as solar, wind, ocean energy, fuel cells, landfill gas, hydroelectric facilities (with specific restrictions), low emission power conversion technologies using agricultural or waste-derived fuels, marine or hydrokinetic energy, and geothermal energy. Importantly, to qualify as a Class 2 renewable generating source, a facility must operate or contract for recycling programs approved by the environmental protection department, with at least 34.75% of revenue from renewable energy certificates allocated to these programs. Retail electric suppliers must provide a minimum percentage of kilowatt-hour sales from these Class 2 sources for contracts executed or extended after January 1, 2009. The bill also specifies that these renewable energy sources can be located behind the customer meter within the ISO-NE (Independent System Operator of New England) control area, provided the output is verified through an independent verification system participating in the NEPOOL GIS (Generation Information System) accounting system.
