This bill modifies an existing law related to rent escrow in summary process (eviction) actions, specifically changing the requirements for tenants when a trial date is continued. Under the new provisions, if a trial date is rescheduled, any party can request that the tenant deposit with the court, an attorney, or another secure depository the monthly rent or the amount specified in the rental agreement, including any back rent from the start of withholding, calculated at the fair market value of the premises. These deposited funds will be held in escrow and, upon final resolution of the eviction case, will first be used to cover any necessary repairs. If a tenant fails to make the required deposit after a court order, the court can schedule an expedited bench trial and issue additional orders as deemed appropriate. This change appears designed to provide more structure and accountability in handling rent payments during extended eviction proceedings, ensuring that property owners receive potential compensation while giving tenants a mechanism to contest eviction based on property condition.
