This bill establishes the Massachusetts Artificial Intelligence Disclosure Act, which requires clear and conspicuous disclosure for AI-generated content created or used within the state. The bill defines key terms such as "artificial intelligence" (AI) as computerized methods that mimic human cognitive abilities, and "AI-generated content" as media substantially created or modified by generative AI systems. Under the proposed law, each piece of AI-generated audio, video, text, or print content must include a permanent or hard-to-remove notice identifying it as AI-generated, along with metadata that specifies the AI system used, creation date, and time. Users of generative AI systems are prohibited from removing these disclosures, with violations subject to fines of at least $500 for a first offense and $1,000 for subsequent offenses. The Office of Consumer Affairs and Business Regulation will be responsible for enforcing the law and can establish additional rules as needed.
