This bill adds a new chapter to the Texas Business & Commerce Code that restricts the sale of obscene devices, defining such devices according to the Texas Penal Code's existing definition. Under the proposed law, businesses in Texas would be prohibited from selling, offering for sale, or holding for sale obscene devices, with an exception for sexually oriented businesses operating under Chapter 102 of local government regulations. County or district attorneys would be empowered to take legal action against businesses violating this restriction, including seeking injunctions and civil penalties up to $5,000 per violation. Additionally, courts could order businesses to reimburse the county or district for the costs of investigating and prosecuting such violations. The bill would take effect immediately if it receives a two-thirds vote in both legislative chambers, or otherwise on September 1, 2025.
