This bill modifies two sections of the Texas Health and Safety Code related to standard permits for concrete plants. Specifically, the bill allows the Texas Commission on Environmental Quality (TCEQ) to require facility operators to update their construction plans if they have not yet begun construction and have filed for an extension, in cases where the commission amends an existing standard permit for permanent concrete plants that perform wet batching, dry batching, or central mixing. The changes apply to two different sections of code (Sections 382.05195 and 382.05198), providing the TCEQ with consistent authority to require plan updates when standard permits are amended and construction has not yet commenced. The bill would take effect immediately if it receives a two-thirds vote in both legislative chambers, or otherwise on September 1, 2025, providing a mechanism for the environmental regulatory agency to ensure that facilities comply with the most current permit standards before beginning construction.
