This bill establishes new regulations for individuals and businesses providing assistance with veterans benefits claims in Texas. The legislation creates comprehensive guidelines for how these services can operate, including strict limitations on compensation and fees. Service providers are prohibited from charging initial or non-refundable fees and can only receive compensation contingent on increasing a veteran's benefits, with fees capped at five times the monthly benefit increase. Providers must disclose in writing that they are not affiliated with official veterans organizations and that free services may be available. The bill mandates that service providers cannot use international call centers, cannot access a veteran's personal login information, and must verify the identity of and conduct criminal background checks on anyone handling veteran information. Violations of these provisions are considered deceptive trade practices, and violators can be subject to civil penalties of up to $500 per violation, with each day of violation counted separately. Any collected penalties will be deposited into the state's fund for veterans' assistance.
