This bill modifies the rules for retired judicial officers who want to resume service under the Judicial Retirement System of Texas Plan Two. Currently, a retiree who returns to full-time judicial service can rejoin the retirement system if they have been separated from judicial service for at least six full consecutive months. The bill adds several new provisions: retirees must provide notice of their election to rejoin within 30 days of taking the oath of office, resume making member contributions at the standard rate, and have specific conditions for recalculating their retirement annuity. If a retiree completes at least 24 months of resumed service, their retirement annuity will be recomputed to reflect the highest state annual salary of their court and include additional service credit. If they do not complete 24 months, their previously suspended annuity payments will resume, and they will receive a refund of contributions. The bill applies to current retirees holding judicial offices and those who resume service on or after the effective date, with the Employees Retirement System of Texas required to adopt rules for implementation. The bill will take effect immediately if it receives a two-thirds vote in the legislature, otherwise it will take effect on September 1, 2025.
