This bill modifies the Texas Local Government Code to provide clearer guidelines for how public utility agencies can be modified or dissolved. Specifically, the bill expands the existing provisions to allow public entities participating in a public utility agency two new options: first, they can add or remove public entities from the agency through concurrent ordinances, and second, they can completely dissolve the public utility agency by transferring all of its obligations, assets, permits, and licenses to the remaining public entities. The bill also adds a provision that allows a public entity that becomes the sole remaining participant in a public utility agency to unilaterally dissolve the agency. This change provides more flexibility for local governments in managing public utility agencies, allowing them to streamline or wind down these organizations as their needs change. The bill is set to take effect on September 1, 2025, giving local governments ample time to prepare for and understand the new dissolution procedures.
