This bill provides a mechanism for local governmental units within the seven-county Metropolitan Council region (Anoka, Carver, Dakota, Hennepin, Ramsey, Scott, and Washington counties) to opt out of the Metropolitan Council's regulatory jurisdiction by filing a resolution with the council. When a local unit opts out, it gains independent authority over development and public infrastructure within its boundaries, becomes exempt from metropolitan system plans, and is generally freed from most Metropolitan Council regulatory requirements. However, the bill includes several important nuances: the opt-out takes effect on January 1 following the resolution filing, the Metropolitan Council can still levy transit taxes in areas within the transit taxing district, the local unit can still apply for council grant programs and enter joint powers agreements, and the council can continue to operate its own properties and transportation services in the area. Notably, a local unit that opts out must wait at least four years before it can opt back into the Metropolitan Council's jurisdiction, and when it does so, it must file a resolution stating that rejoining is in its best interest.
