This bill aims to address bullying and harassment in public schools by requiring states receiving federal grants to implement comprehensive anti-bullying policies. The legislation defines bullying as conduct that prevents students from fully participating in educational programs and creates a hostile school environment. It mandates that local educational agencies develop policies that explicitly prohibit bullying and harassment based on characteristics such as race, color, national origin, sex, sexual orientation, gender identity, disability, and religion. Schools must provide annual notices to students, parents, and educators about prohibited conduct, establish grievance procedures for complaints, and collect and publicly report annual data on bullying incidents while protecting the privacy of those involved. The bill recognizes that bullying can have serious psychological and academic consequences, including increased dropout rates and decreased learning opportunities. It emphasizes the importance of evidence-based interventions like Positive Behavior Interventions and Supports (PBIS) and restorative practices, and acknowledges that students who bully may themselves be victims of trauma or psychological distress. The legislation also ensures that these new requirements do not invalidate existing federal and state non-discrimination laws and do not restrict free speech rights. Every two years, the Secretary of Education will conduct an independent evaluation of these anti-bullying programs and report findings to the President and Congress.
