This bill modifies the governance rules for municipal housing authorities in Texas by differentiating appointment procedures based on municipal population size. For municipalities with 40,000 or more residents, the presiding officer of the municipal governing body will continue to appoint five to eleven housing authority commissioners, while for municipalities with fewer than 40,000 residents, the entire municipal governing body will make these appointments by majority vote. The bill maintains the existing requirement that commissioners cannot be municipal officers or employees and must comply with other existing appointment requirements. Additionally, the bill provides a modification to tenant representation rules, allowing municipalities with housing authorities of 150 or fewer units to be exempt from mandatory tenant commissioner appointments if they cannot find an eligible tenant or housing assistance recipient after providing timely notice and waiting 60 days. Existing commissioners may continue to serve their current terms, and as terms expire or vacancies occur, new appointments will be made according to the updated rules. The bill is set to take effect on September 1, 2025, providing municipalities time to adjust to the new appointment procedures.
