This bill amends Section 44.031(f) of the Texas Education Code to clarify the rules regarding contracts for professional services in school districts. Specifically, the bill adds language to prevent professional services providers from circumventing standard district purchase procedures by buying goods or services on behalf of a school district in a way that would normally require competitive bidding or other procurement guidelines. The existing law already exempts certain professional services like architects, attorneys, accountants, engineers, and fiscal agents from standard contract procurement methods, and allows districts to optionally contract with financial or technology consultants using alternative procedures outlined in the Government Code. The new provision ensures that these exemptions cannot be used as a loophole to bypass normal purchasing requirements. The bill will take effect on September 1, 2025, giving school districts and service providers time to understand and implement the new restriction.
