This bill proposes to modify the Texas Human Resources Code by restricting what food and drink items can be purchased using Supplemental Nutrition Assistance Program (SNAP) benefits, commonly known as food stamps. Specifically, recipients would be prohibited from buying energy drinks (defined as beverages with at least 65 milligrams of caffeine per 8 ounces), sweetened beverages, carbonated drinks, candy, potato or corn chips, and cookies that are packaged for immediate consumption. However, the bill includes several exceptions to these restrictions, such as milk products, milk substitutes, beverages with no-calorie sweeteners, infant formula, weight reduction beverages, certain fruit and vegetable juices, beverages recommended by healthcare professionals, and products fortified with vitamins, minerals, or protein. The bill requires state agencies to seek any necessary federal waivers before implementation and is set to take effect on September 1, 2025, with the aim of promoting healthier food choices among SNAP recipients.
