This bill introduces a comprehensive framework for reviewing and modifying land development regulations in certain large counties and municipalities (specifically those with populations of 500,000 or more for counties and 200,000 or more for municipalities). The bill requires these local governments to conduct a thorough review of their existing land development regulations at least once every 10 years, examining factors such as the regulation's impact on housing development, its benefits to landowners and residents, potential impediments to energy or water conservation technologies, and the costs imposed on affected parties. During this review, the governing body must hold at least one public hearing and provide an opportunity for public comment. Before adopting or modifying any new land development regulation, the local government must prepare a detailed impact statement that analyzes the fiscal implications, assesses the regulation's benefits to public health and welfare, and evaluates its potential impact on housing costs. The local government can only adopt or modify a regulation if it determines that the regulation is consistent with public health and safety priorities, has minimal fiscal impact, and does not negatively affect housing costs. The bill mandates that the first comprehensive review of existing land development regulations must be completed by September 1, 2030, and the provisions of the bill will take effect on September 1, 2025.
