Bill Summary

AN ACT relating to vicarious liability of certain health organizations for medical care provided by a physician the organization employs.

AI Summary

This bill modifies Texas state law regarding the vicarious liability of health organizations for medical care provided by physicians they employ. Specifically, the bill adds a provision that prevents a health organization from being held vicariously liable (legally responsible for another's actions) for medical care provided by a physician they employ, provided that the organization does not interfere with, control, or direct the physician's independent medical judgment when treating patients. The bill makes a minor change to the section heading of existing law, replacing "ORGANIZATION POLICIES" with "POLICIES OF CERTAIN HEALTH ORGANIZATIONS; VICARIOUS LIABILITY" to better reflect the scope of the provision. The legislation would take effect immediately if it receives a two-thirds vote in the Texas Legislature, or otherwise on September 1, 2025. This change appears designed to protect health organizations from legal liability when they allow physicians to exercise professional medical discretion without organizational interference.
