This bill adds a new section to the Texas Health and Safety Code that regulates exclusive contracts for municipal solid waste management services. The legislation defines an "exclusive contract" as an agreement between a public agency and a private waste management service provider that grants the provider exclusive rights to provide certain waste collection or transportation services in the agency's jurisdiction. When a public agency enters into such a contract (including renewals or amendments that expand service rights), they must publish a detailed notice in a local newspaper and on their website, describing the contract's purpose and changes. The bill also protects existing service providers by allowing current contractors to continue their services until their contract expires or up to one year after the notice is published, and providers without existing contracts can continue services for up to 60 days after the notice. The notice requirements aim to increase transparency around municipal waste management service agreements. The bill does not apply to waste services provided by a municipality to an annexed area, and it will only affect contracts entered into on or after its effective date, which is immediately upon receiving a two-thirds vote in the Texas legislature or, if that threshold is not met, on September 1, 2025.
