This bill adds a new section to the Texas Parks and Wildlife Code that requires advance notice for constructing tall structures near National Wildlife Refuges in specific counties. Specifically, the bill applies to counties with less than 500,000 residents that either border the Gulf of Mexico and contain a National Wildlife Refuge or are adjacent to such a county. Under this legislation, anyone planning to construct a structure taller than 500 feet must provide the Texas Parks and Wildlife Department with at least 90 days' notice before beginning construction, including sufficient details for the department to evaluate potential wildlife impacts. The department can then investigate the proposed structure and, if it determines the construction would materially damage wildlife, seek a court injunction to limit or stop the construction. If the department takes no action within 90 days, the person may proceed with construction. The bill allows district courts in the county where the structure is proposed to grant injunctive relief at the department's request, and notably, the department is not required to post a bond when seeking such relief. The bill would take effect immediately if it receives a two-thirds vote in the Texas legislature, or otherwise on September 1, 2025.
