This bill adds a new requirement for property sellers in specific Texas counties (those containing a city with over 500,000 people and bordering an international border) when selling lots of 5 acres or less. Sellers must now provide potential buyers with a written statement, printed in both English and Spanish using 14-point bold-face or capital letters, that clearly specifies whether the property currently has water service. If a seller fails to provide this statement before the purchaser signs the executory contract (a preliminary agreement to sell), the buyer has the right to terminate the contract for any reason within seven days of receiving the notice or before the property transfer occurs. The bill is designed to ensure transparency in real estate transactions by requiring sellers to disclose the water utility status of the property upfront, giving buyers more information to make informed decisions. The new law will take effect on September 1, 2025.
