This bill creates a new category of driving permits for individuals who have resided in Texas for at least one year but cannot provide standard immigration documentation. The Texas Department of Public Safety will be authorized to issue three types of permits: a Texas conditional driver's permit, a provisional Texas conditional driver's permit, and a Texas conditional learner permit. Applicants must complete a driver education course and pass required examinations, with some flexibility for learner permits. These permits will be clearly marked as valid only for driving purposes and not for federal identification, such as voting. Applicants must provide specific documentation to verify identity, including passports, border crossing cards, or tax identification numbers, and submit fingerprints, a photograph, and personal information. The permits will be valid for two years for adults and until the holder's 18th birthday for younger individuals. The fee for these permits is set at $100 or less, depending on the department's administrative costs. The department must adopt rules for permit design, eligibility criteria, and criminal background checks. Importantly, all information collected during the application process will be kept confidential and cannot be used in legal proceedings. The bill is set to take effect on September 1, 2025, with the Department of Public Safety required to develop implementation rules by January 1, 2026.
