This bill creates new restrictions on air quality permits for aggregate production or crushing facilities located near specific geographic features in Texas. Specifically, the bill prohibits the Texas Commission on Environmental Quality (TCEQ) from issuing permits or permit amendments for facilities that are within four miles of a lake owned by a river authority that supports a national fish hatchery, within four miles of a state park entrance containing a National Natural Landmark cavern, or within two miles of a youth camp founded in 1975 and licensed by the Department of State Health Services. The prohibition does not apply to facilities that already have a permit or standard permit authorization as of January 1, 2025. The bill would take effect immediately if it receives a two-thirds vote in the Texas Legislature, or otherwise on September 1, 2025. This legislation appears aimed at protecting specific environmentally or historically significant sites from potential air quality impacts of aggregate production facilities by creating geographic restrictions on permit issuance.
