This bill amends the environmental conservation law by adding a new section that allows wetland mitigation to occur within the same watershed as the proposed project. Specifically, when reviewing permit applications that involve wetlands, regulatory agencies can now approve mitigation proposals that enhance existing wetland benefits or create new wetland benefits within the same watershed as the original project site. A watershed is a geographical area where all water sources drain to a common point, such as a river, lake, or ocean. The purpose of this bill appears to be providing more flexibility in wetland conservation and restoration efforts by allowing mitigation activities to take place in nearby areas with similar ecological characteristics, rather than requiring mitigation to occur at the exact same location as a proposed development or activity that might impact wetlands. The bill will take effect immediately upon becoming law.
