This bill amends the Texas Government Code to modify how the Texas Department of Housing and Community Affairs (TDHCA) evaluates and scores applications for low income housing tax credits. The bill adds a new scoring criterion specifically for developments in urban areas with counties over one million people, requiring those developments (except supportive housing and elderly-focused projects) to provide a high-quality prekindergarten program and associated educational space that meets specific departmental requirements. The scoring system will continue to prioritize factors such as financial feasibility, community participation, tenant income levels, unit size and quality, rent levels, development costs, tenant services, and community support. The bill also maintains existing provisions that encourage applicants to provide free notary services and give housing preference to low-income veterans in certain counties. The changes will apply only to applications submitted during the 2026 or subsequent qualified allocation plan cycles, ensuring that existing applications are evaluated under the rules in effect when they were submitted. The bill will take effect on September 1, 2025, giving stakeholders time to prepare for the new requirements.
