Bill Summary

AN ACT to amend the insurance law, in relation to reimbursement for testing for familial dysautonomia, Canavan's disease and Tay-Sachs

AI Summary

This bill requires all insurance policies in New York that provide hospital, surgical, or medical care coverage, or reimburse for laboratory tests or diagnostic X-rays, to include coverage for genetic testing for three specific genetic disorders: familial dysautonomia, Canavan's disease, and Tay-Sachs. These are rare genetic conditions that primarily affect certain populations, such as those of Ashkenazi Jewish descent. The bill mandates that this coverage be added to new policies immediately and to existing policies at their next anniversary date, subject to evidence of insurability. To protect patient privacy, the bill stipulates that simply receiving an acknowledgment from the laboratory performing the test will be considered sufficient proof of testing. Additionally, the coverage may be subject to annual deductibles and co-insurance, as determined by the insurance superintendent and consistent with other benefits in the policy. The changes apply to individual insurance policies, group policies, and medical and health service corporations, ensuring broad coverage across different types of health insurance providers in the state.
