This bill amends the Texas Education Code to enhance state auditing of higher education institutions' use of legislative appropriations. Specifically, the bill requires the state auditor to conduct compliance audits of each institution of higher education at least once every four years to determine whether they have spent legislative funds appropriately. If an audit finds that an institution has misused funds, the institution must remedy the violation within 180 days. Failure to cure the violation within that timeframe will result in the institution becoming ineligible for formula funding increases, institutional enhancements, or exceptional items during the immediately following state fiscal biennium. The bill replaces the general term "state money" with the more specific "funds appropriated by the Legislature for the fiscal year" to provide clearer language about the type of funds being audited. The legislation will take effect immediately if it receives a two-thirds vote in both legislative houses, or otherwise will become effective on September 1, 2025.
