This bill establishes a Transnational Repression Working Group within the Department of Homeland Security to address growing threats from foreign governments targeting individuals in the United States and abroad. The working group will be responsible for analyzing and monitoring transnational repression, which is defined as coercive actions by foreign governments or their agents intended to harass, threaten, or intimidate individuals, including efforts to suppress First Amendment rights or retaliate against people for exercising those rights. The group will be led by a Director appointed by Homeland Security Investigations and will have at least one employee dedicated to ensuring privacy law compliance. The working group will conduct annual assessments of transnational repression incidents, including quantitative analyses of responsible individuals, their countries of origin, and the roles of foreign governments in these actions. The group will share information with federal, state, local, tribal, and territorial partners and will be required to respect constitutional, privacy, civil rights, and civil liberties protections. The working group is authorized to accept detailees from intelligence agencies and other federal agencies and will conduct research on technologies to counter transnational repression. The group is set to operate for seven years from the date of enactment, with the goal of reducing risks to people in the United States from foreign government intimidation and harassment.
