For each offense, the reports must include a list of the offense's specific elements, potential criminal penalties, the number of prosecutions over the past 15 years, and the mens rea (mental state or intent) requirement. The bill mandates that these reports be submitted to the Judiciary Committees of both the Senate and House of Representatives. Additionally, within two years of enactment, the Attorney General and agency heads must create publicly accessible online indexes of these criminal offenses, which will be hosted on their respective websites. The bill covers a wide range of federal agencies, including Departments of Agriculture, Commerce, Homeland Security, and many others, and aims to provide transparency and clarity about federal criminal offenses. Importantly, the bill does not authorize or require additional funding for its implementation.
