This bill provides legal protections for survivors of domestic abuse, sexual assault, or stalking by allowing them to request the suspension of remote access vehicle tracking technology that could be used to monitor or control them. The bill defines key terms such as "abuser" (someone who has committed a covered act), "survivor" (the victim), and "remote access technology" (smartphone apps or devices that can track or control a vehicle). Under the new law, motor vehicle manufacturers must suspend remote access technology within two business days of receiving a complete request, which requires either a protective order, temporary restraining order, or documentation of the covered act, along with proof of vehicle ownership or exclusive use. Manufacturers cannot charge a fee for this service or contact the abuser after receiving the request. Violations can result in a civil fine of up to $10,000 per instance, not exceeding $1 million, with collected funds deposited into a new Survivor Empowerment Fund to assist crime victims. The bill also provides liability protection for manufacturers who attempt to comply with the law, and mandates that manufacturers provide a clear, prominent link on their websites explaining how to disconnect remote vehicle access.
