This bill updates the procedures for determining the incapacity of the Governor and Lieutenant Governor in Pennsylvania, primarily by standardizing language around disability and clarifying the process for transferring executive powers. The bill modifies the existing Governor and Lieutenant Governor Disability Procedure Law to specify that when either the Governor or Lieutenant Governor is unable to discharge their duties, they must provide a written declaration of incapacity to the General Assembly. If the Governor is incapacitated, the Lieutenant Governor assumes the powers and duties as Acting Governor; similarly, if the Lieutenant Governor is incapacitated, the President Pro Tempore of the Senate becomes the Acting Lieutenant Governor. The bill introduces additional methods for transmitting official declarations, including email and facsimile, and provides a detailed process for challenging and resolving disputes about an official's capacity. If there is a disagreement about the incapacity, the General Assembly can make a final determination through a two-thirds vote in each House within twenty-one days. The bill also defines the Governor's Cabinet as the heads of Administrative Departments appointed by the Governor and specifies new communication protocols for transmitting official declarations. The legislation will take effect 60 days after its passage.
