This bill amends Pennsylvania's public utilities law to require an additional step in the process of acquiring water and wastewater systems. Specifically, before beginning any proceeding for a fair market value acquisition of a utility, the selling utility must request and make publicly available documentation from the Independent Fiscal Office (IFO). This documentation must include three separate analyses: first, an examination of the costs and benefits of maintaining the current ownership structure of the selling utility; second, an analysis of the costs and benefits if the utility is acquired by a public utility under the specific section of law being amended; and third, an analysis of the costs and benefits if the utility is acquired under a different section of law related to water and sewer utility acquisitions. The documentation must be made available both in-person and on a publicly accessible website, with the goal of providing transparency and comprehensive information about potential utility transfers. The bill will take effect 60 days after its enactment, giving utilities time to prepare for the new documentation requirements.
