This bill provides legal protections for staff members in both school and public libraries by granting them immunity from criminal and civil liability when they act in good faith while providing access to or helping patrons access library materials. Specifically, the bill defines "library materials" broadly to include books, periodicals, pamphlets, journals, newspapers, audio and audiovisual materials, instructional materials, maps, databases, government documents, records, and photographs. For school libraries, the protection extends to library media specialists, librarians, licensed and unlicensed employees assigned to library duties, and anyone assisting with library functions. Similarly, for public libraries, the immunity applies to all staff members, including librarians. The bill aims to protect library staff from potential legal challenges that might arise from their efforts to provide access to information and resources, recognizing the important role libraries play in providing educational and informational materials to pupils and patrons. The legislation will become effective on July 1, 2025, and applies to both school and public libraries in the state.
