AI Summary
This bill establishes a Certified Microgrid Program and High Impact Data Center Program in West Virginia, designed to attract and support large-scale data centers and microgrid infrastructure. The legislation creates a comprehensive framework for developing and regulating microgrid districts and high-impact data centers, offering significant economic incentives and regulatory exemptions. Key provisions include allowing microgrid districts to generate and distribute electricity with minimal Public Service Commission oversight, creating special tax treatment for high-impact data centers, and establishing a specialized valuation and distribution method for property taxes generated by these facilities. The bill specifically aims to position West Virginia as an attractive location for data center development by offering a streamlined regulatory environment, emphasizing the state's strategic advantages such as proximity to Washington D.C., abundant energy resources, and a skilled workforce. The legislation also includes provisions for creating an Electric Grid Stabilization and Security Fund and requires special reporting and certification processes for data centers and microgrid projects. Notably, the bill includes provisions that align with national security interests by encouraging data center development within the United States and away from potential foreign competitors. The programs are set to take effect on July 1, 2025, and include sunset provisions that will expire on December 31, 2055.
