Bill Summary

AN ACT to amend the public health law, in relation to requiring transparency requirements for certain 340B drugs

AI Summary

This bill requires hospitals and other healthcare providers participating in the 340B drug discount program to submit comprehensive annual reports to the New York State Department of Health detailing their use of the program. The 340B program allows certain healthcare organizations to purchase outpatient drugs at significantly reduced prices to help them serve vulnerable patient populations. The required reports must include detailed financial information such as drug acquisition costs, payments received, total prescriptions filled with 340B drugs, and the percentage of low-income patients served. Providers must also disclose costs related to implementing drug discount programs, payments to contract pharmacies and third-party administrators, and the number and location of contract pharmacies. An authorized officer of each covered entity must certify the report's accuracy, and the Department of Health will publish these reports on a public website starting April 1, 2026. The goal of this legislation is to increase transparency about how healthcare organizations are using the 340B drug discount program and ensuring that the program's benefits are being passed on to patients, particularly those with lower incomes.
