Bill Summary
AN ACT AMENDING THE WAGE AND HOUR ACT TO REQUIRE EMPLOYERS TO PROVIDE A TWENTY-MINUTE PAID BREAK TO ANY EMPLOYEE WORKING A SHIFT OF SIX HOURS OR MORE.
AI Summary
This bill amends North Carolina's Wage and Hour Act to require employers to provide paid rest breaks for employees working shifts of six hours or more. Specifically, employers must offer each employee a voluntary paid break of at least 20 minutes, scheduled near the middle of the workday. The break cannot be used to shorten the overall work period without the employer's approval. If an employer violates this new requirement, they will be subject to civil penalties: $100 for the first violation and $500 for subsequent violations. The penalty amount will be determined based on the size of the business and the severity of the violation. Employers who are penalized have 15 days to contest the determination through an administrative and potentially judicial proceeding. The law will take effect immediately upon becoming law and will apply to all employment in North Carolina from that date forward.
