This bill requires that all children participating in the Women, Infants, and Children (WIC) program receive lead testing at intervals and using methods specified by the New York State Department of Health. The WIC program is a federal nutrition assistance program that provides food, nutrition education, and health services to low-income pregnant women, new mothers, infants, and children. Importantly, the bill stipulates that federal WIC program funds cannot be used to implement or administer these new lead testing requirements. Instead, funding for the lead testing will be made available through medical assistance for needy persons under existing state social services law, to the extent permitted by federal regulations. The bill will take effect 90 days after it becomes law, which means healthcare providers and WIC program administrators will need to develop protocols to ensure all child participants undergo the required lead testing.
