This bill establishes the Medical Equipment Right to Repair Act, which requires original equipment manufacturers (OEMs) of medical imaging and radiation therapy equipment to provide equipment owners and independent repair providers with access to support documentation, tools, and parts necessary for diagnostic, maintenance, and repair services. The bill defines key terms such as medical imaging equipment (devices used to view the human body for medical purposes), medical radiation therapy equipment (devices that produce high-energy charged particles for treatment), authorized repair providers (those contracted with manufacturers), and independent repair providers (those not contracted with manufacturers). OEMs must make support documentation available at no charge, provide tools without unnecessary authorization barriers, and offer parts at the same cost as their most favorable agreements with authorized repair providers. The bill also requires OEMs to offer training materials to owners and independent repair providers if such training is provided to authorized repair providers. Violations of the act are considered unfair trade practices, subject to legal action, but OEMs are not required to disclose trade secrets. The act becomes effective on July 1, 2025, and applies to equipment in use on or after that date, with provisions designed to ensure fair access to repair resources while protecting manufacturers' intellectual property rights.
