This bill modifies Florida's existing law regarding public records exemptions for insurance-related documents held by the Department of Financial Services when acting as a receiver for an insurer. The bill revises the types of records that are considered confidential and exempt from public disclosure, removing some previously exempted categories like underwriting files and own-risk and solvency assessment (ORSA) reports, while maintaining exemptions for personal financial and health information, consumer claim files, personnel and payroll records, and certain information received from other governmental entities. The bill eliminates the previous provision that would have automatically repealed these exemptions on October 2, 2025, effectively making these record protections permanent. The bill continues to allow the confidential records to be released under specific circumstances, such as for regulatory investigations, to other government agencies, to the National Association of Insurance Commissioners, to guaranty associations handling claims, and to the consumer to whom the information pertains.
