This bill establishes two primary restrictions on land ownership and infrastructure agreements for entities from countries designated as foreign adversaries by the U.S. Secretary of Commerce. First, the bill prohibits citizens or businesses from countries designated as foreign adversaries from purchasing, leasing, or acquiring agricultural land or land within 100 miles of a military installation in Alaska, with some exceptions such as residential leases and for U.S. citizens who are also citizens of those countries. Second, the bill prevents state agencies and political subdivisions from entering into agreements with companies from these countries that would allow direct or remote access to critical infrastructure facilities or their cybersecurity systems. Critical infrastructure is broadly defined to include manufacturing facilities, utilities, transportation infrastructure, energy facilities, and military installations. If violations occur, the attorney general can investigate and seek forfeiture of the land or terminate the agreement, with proceeds from any land sales deposited into the state's general fund. The bill includes provisions protecting existing leases made before July 1, 2025, and explicitly states that individuals are not liable for failing to determine whether another party is prohibited from land ownership or infrastructure agreements. The legislation is set to take effect on July 1, 2025.
