This bill establishes comprehensive requirements for fire life safety damper testing in buildings, excluding single-family and small multi-family residences. The legislation mandates that building owners create an inspection verification program to ensure fire life safety dampers and smoke control systems are functioning correctly to prevent fire and smoke spread. Building owners must have newly installed fire life safety dampers tested before use, with periodic inspections thereafter - annually in the first year, then every four years for most buildings (every six years for hospitals). Inspections must be conducted by qualified inspectors, including authorized fire department personnel or certified technicians who meet specific professional standards, such as holding specific certifications from the International Certification Board. The bill requires detailed documentation through a certificate of operation that includes information about the inspector, building, and specific damper locations. Building owners must maintain these certificates on-site and submit copies to the state fire marshal. Failure to comply results in a $100 daily civil penalty, and the state fire marshal is authorized to conduct enforcement actions. The commissioner of public safety is tasked with adopting administrative rules to implement these requirements, with the act taking effect either after rule adoption or by July 1, 2025, whichever comes first.
