This bill establishes a new process to provide additional time and support for special education teachers to complete required documentation. Beginning in the 2025-2026 school year, school districts (including charter schools and cooperative units) must negotiate an agreement with teachers' unions to provide four contract days per year specifically for completing due process forms and procedures related to Individualized Education Programs (IEPs) and Individualized Family Service Plans (IFSPs). These four days must be equally distributed throughout the school year and will be in addition to existing preparation time. If districts and unions cannot agree on a staffing plan, the district must use the allocated funds to provide substitute teachers to cover classes while special education teachers complete their documentation. The Department of Education will calculate a statewide allowance per student to fund these additional days, starting in fiscal year 2026, and will adjust the allowance annually based on actual expenses. The bill includes an appropriation to support the implementation of this new due process aid, with the provisions becoming effective the day after final enactment and fully implemented by July 1, 2025.
