This bill creates an expedited licensure process for health care facilities operated by entities seeking to reopen a facility in the same physical location where a previous facility closed within the last 24 months due to voluntary closure or financial hardship. The Oregon Health Authority (OHA) and Department of Human Services (DHS) are required to establish this fast-track licensing procedure, which allows eligible applicants to receive a license more quickly if they meet specific criteria. Applicants must currently operate a similar health care facility in the state, be in good standing with state regulations, have no outstanding compliance issues, and ensure all healthcare providers are properly licensed. The bill provides for two types of licensing: non-long-term care facilities must receive a license within 45 days, while long-term care facilities will be processed "as soon as reasonably practicable." Additionally, applicants can receive a provisional license while their full application is being reviewed, provided they submit an attestation of meeting health and safety requirements and pass an initial site inspection that demonstrates no immediate patient health risks. The expedited process includes provisions for waiving certain construction and inspection requirements, though licenses cannot be issued for facilities requiring a certificate of need that has not been obtained.
