This bill introduces two key protections for commercial vehicles and cargo in North Carolina. First, the bill prohibits the use of immobilization devices (like boots) on commercial motor vehicles for parking enforcement, making such actions a Class 2 misdemeanor. Second, the bill mandates that when a commercial vehicle is towed by a tower, either through a nonconsensual tow or at the direction of law enforcement, the tower must promptly return any commercial cargo to its owner or the owner's designee upon request. Additionally, in cases involving a trailer with commercial cargo, the tower must allow the trailer to be exchanged with a similar trailer in good working condition that is manufactured within the last five years or newer, as arranged by the commercial cargo owner. The first provision will become effective on December 1, 2025, and apply to offenses committed on or after that date, while the rest of the bill becomes effective immediately upon becoming law.
