This bill authorizes the Empire State Development Corporation (ESD), through its statewide advocate, to hire one or more independent Minority and Women-Owned Business Enterprise (MWBE) consultant firms to conduct a comprehensive review of procurement procedures used by state agencies. The review will specifically examine the procurement processes, assess the staffing levels and training of procurement personnel, and evaluate the outreach strategies used to engage with minority-owned and women-owned businesses during procurement. These independent MWBE consultants will be required to provide quarterly reports detailing their findings and recommendations for improving the procurement process to the statewide advocate. The bill will take effect 90 days after becoming law, with a provision that these amendments will be repealed in conjunction with the existing article related to minority and women-owned businesses in the executive law. This legislation aims to enhance transparency, effectiveness, and inclusivity in state agency procurement practices by leveraging independent expert analysis.
