This bill amends Arkansas law regarding the towing and storage of vehicles, implements, or machinery without the owner's consent. Specifically, the bill requires towing and storage companies to release a vehicle to its owner or the owner's representative, even if the owner has not yet paid the possessory lien (a legal claim on the vehicle to secure payment of a debt). However, the owner is then prohibited from selling the vehicle without first satisfying the lien. If an owner attempts to sell the vehicle before paying the lien, they will commit a Class C misdemeanor and, upon conviction, will be required to pay twice the amount of the original lien to the lien holder. This legislation appears designed to provide vehicle owners with more immediate access to their property while still ensuring that towing and storage companies can ultimately recover their fees.
